This Privacy Policy (“Policy”) applies to BostonPads.com (“Site”) and Boston Pads, LLC (“Company”) and governs data collection and usage with respect to those users of the Site (“Visitors”) that visit without transacting business and Visitors that transact business on the Site (“Customers”) and make use of products and/or services offered by the Company (collectively, “Services”). For the purposes of this Privacy Policy, unless otherwise noted, all references to the Company include BostonPads.com and Boston Pads subsidiaries. The Company’s website is a real estate platform. By using the Company website, you consent to the data practices described in this statement.
“Personally Identifiable Information” (PII) refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. PII does not include information that is collected anonymously (that is, without identification of the individual User) or demographic information not connected to an identified individual.
What Personal Information Do We Collect?
PII You Disclose to Us
We collect personal information that you voluntarily provide to us when you elect to use certain Services provided by the Company. These may include:
- Registering for an account
- Entering a sweepstakes or contest sponsored by us or one of our partners
- Signing up for special offers from selected third parties
- Submitting a contact form
- Expressing an interest in a property
- Purchasing Services from the Company
- Participating in other activities on the Site
The personal information that we collect depends on the context of your interactions with the Company and the Site, the choices you make, the transactions in which you engage with the Company, and the Services and features you use. - Registration Information such as username, password, contact, and authentication data
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Automatically Collected Information
We automatically collect certain information when you visit, use, or navigate the Site. This information does not reveal your specific identity (such as your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use the Site, and other technical information. This information is primarily needed to maintain the security and operation of the Site, and for our internal analytics and reporting purposes.

Non-Personally Identifying Information We Collect Includes
- Log and Usage Data. Log and usage data is service-related, diagnostic usage and performance information our servers automatically collect when you access or use the Site and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings, and information about your activity on the Site (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports, and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet or other device you use to access the Site. Depending on the device used, this device data may include information such as your IP address (or proxy server), device application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, and operating system configuration information.
- Location Data. We collect information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type of device you use to access the Ste and the settings on that device. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information in your browser or device, or by disabling the location/GPS settings on your device. However, if you choose to opt out, you may not be able to use certain parts of the Site, and certain parts of the Site may not function properly for you.
Information Collected from Other Sources
In order to enhance our ability to provide relevant marketing, offers, and Services to you, and update our records, we may obtain information about you from other sources. These sources may include, but are not limited to, public databases, joint marketing partners, affiliate programs, data providers, social media platforms, advertising platforms, and other third party information providers. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), demographic data, Internet Protocol (IP) addresses, social media profiles, social media URLs and custom profiles, for purposes of targeted advertising and event promotion. If you interact with us on a social media platform using your social media account (e.g. Facebook, Instagram, or LinkedIn), we receive personal information about you such as your name, email address, and demographic information. Any personal information that we collect from your social media account depends on your social media account’s privacy settings.
How Do We Use Your Information?
We use information that we collect about you or that you provide to us, including PII, for a variety of business purposes described below. We process your personal information for these purposes in accordance with our legitimate business interests, in order to enter into or perform a transaction with you, with your consent, and/or for compliance with our legal obligations. We use your information to:
- Present the Site to you and enable you to use it as a Visitor or Customer
- Facilitate the account creation and login process
- Manage Customer accounts
- Process payments
- Provide Services and information that you have requested from us
- Provide administrative communication about Services or information you have requested, accounts you have created, or properties about which you have requested information

Notice to Visitors and Customers in the European Union
Company operations are located solely within the United States. If you provide information to us, the information will be transferred out of the European Union (EU) to the United States. By providing personal information to us, you are consenting to its storage and use as described herein.
Will Your Information Be Shared With Anyone?
We share PII with your consent to comply with laws or legal orders, to provide you with Services, to protect your rights, or to facilitate business operations. We may process or share your data that we hold based on the following:
- Consent. We may process your PII if you have given us specific consent to use that information for a specific purpose.
- Legitimate Interests. We may process your PII when it is reasonably necessary to achieve our legitimate business interests.
- Performance of a Transaction. Where you have entered into a transaction with us, we may process your personal information to fulfill the transaction and deliver the Service.
- Legal Obligations & Vital Interests. We may disclose your PII without notice when we are legally required to do so or in the good faith belief that such action is necessary to
- Comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements)
- Investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person, illegal activities, to protect and defend the rights or property of the Company, or as evidence in litigation in which we are involved
More specifically, we may need to process or share your PII in the following situations:
- Business Transfers. We may share or transfer PII in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service, and marketing efforts. We may allow selected third parties to use tracking technology on the Site, which will enable them to collect data on our behalf about how you interact with the Site over time. - Affiliates. We may share PII with our affiliates, in which case we will require those affiliates to honor this privacy notice.
- Other Users. When you share PII (for example, by posting comments, reviews, or other contributions to the Site) or otherwise interact with public areas of the Site, such personal information may be viewed by all Visitors and may be publicly made available outside the Site in perpetuity. We strongly recommend not posting PII on public areas of the Site.
The Company may sell, rent, or lease customer information to third parties for the following reasons:
- Offer them services that may help them with their real estate needs.
Opt-Out of Sale or Disclosure of Personal Information to Third Parties
In connection with any personal information we may sell or disclose to a third party for a business purpose, you have the right to know:
- The categories of personal information about you that we sold and the categories of third parties to whom the personal information was sold; and
- The categories of personal information that we disclosed about you for a business purpose.
You have the right under the California Consumer Privacy Act of 2018 (CCPA) and certain other privacy and data protection laws, as applicable, to opt out of the sale or disclosure of your personal information. If you exercise your right to opt out of the sale or disclosure of your personal information, we will refrain from selling or disclosing your personal information, unless you subsequently provide express authorization for the sale or disclosure of your personal information. How is Your Information Handled by Third Party Websites?
The Site may contain links to other web sites or advertisements that link to third party websites. Please note that when you click on one of these links, you are moving to another web site. We encourage you to read the privacy statements of these linked sites as their privacy policies may differ from ours. We are not responsible for the privacy practices of any third party website or the safety and security of any PII that you share with a third party website.
Google Web Fonts, Google Maps, and Other Google Services
The Site may use the following Google services that may collect PII and Non-PII when you visit any page on the Website.

- Google RECAPTCHA
- Google Ads
- Other Google Services & API’s
When you open a page on the Site, your browser will load the required data, including cookies and other files added to or loaded from your browser cache, provided by Google’s services or required for these services to operate or be displayed correctly. For this purpose your browser has to establish a direct connection to Google’s servers. Google thus becomes aware that our web page was accessed via your IP address. YouTube
The Site may display embedded video from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages featuring an embedded YouTube video, a connection to the YouTube servers is established and the YouTube server is informed about which of our pages you have visited. If you’re logged in to your YouTube account, YouTube allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.
Submissions
Any communications or materials (“Submissions”) you transmit to the Company, electronically or otherwise, that do not constitute PII as defined in this policy are and will be treated as non confidential and nonproprietary. Any Submissions you transmit or post may be used by the Company for purposes including but not limited to reproduction, disclosure, transmission, publication, broadcast, sale, or other use. the Company is also free to use any ideas, concepts, know-how, techniques or other information contained in any Submission for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products and services.
Personally Identifiable Information Disclosure for Testimonials & Reviews
If you submit a review, or if we choose to use your communication as a testimonial or product review, we will credit you by listing your first name and the first initial of your last name along with your city and state and/or company and title. You may ask that your testimonial or review be removed from our marketing, advertising, Site, and other communications by using the contact form on the Site.
How Long Do We Keep Your Information?
We keep your PII as long as is necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). Your PII may also be stored in secure backup archives where it is isolated from processing.
How Do We Keep Your Information Safe?
All of our employees are familiar with our security policy and practices. The PII of our Visitors and Customers is only accessible to qualified employees, contractors, and service providers. Credit card numbers are processed by PCI-compliant third party payment processors. Sensitive information is protected by standard encryption protocols in place to protect information sent over the Internet. PII is stored and processed on our servers in the United States. Laws governing the storage and security of PII in the United States may be less stringent than the laws of your country of residence or citizenship.
We have implemented the appropriate technical and organizational security measures to protect your PII. However, despite our safeguards, processes, and commercially reasonable efforts to secure your information, electronic communications and databases are subject to errors, and no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. We will not be liable to Visitors, Customers, or any other users of the Site, or any other user of any of our Services for any such occurrences. Although we will do our best to protect your personal information, transmission of personal information to and from the Site is at your own risk. You should only access the Site within a secure environment.
Email & Text Message Communications
From time to time, the Company may contact you via email or text message for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email or text message from the Company or click on a link therein.
By choosing to contact a property, you also agree that BostonPads, Jacob Realty, NextGen Realty, Boardwalk Properties, Douglas Paul Real Estate, landlords, and property managers may call or text you about any inquiries you submit through our services, which may involve use of automated means and prerecorded/artificial voices. You do not need to consent to text message communications as a condition of renting any property, or buying any other goods or services. Message/data rates may apply to any text message communications.
If you would like to stop receiving marketing or promotional communications via email from the Company, you may opt out of such communications using the unsubscribe links provided in those emails or by disabling those communications in your Site account. To stop text message communications, reply “STOP” via text message to the number that texted you. To resume text message communications after unsubscribing, text “START” to the number that texted you.
How Do We Process Children’s Information?
Children under the age of 13 are not eligible to use the Site or our Services unsupervised. Persons under the age of 13 should not submit any information to us or engage in any transaction on the Site. We do not knowingly collect PII from anyone under the age of 13 (see the U.S. Children’s Online Privacy Protection Act.). If the Company becomes aware that we have collected PII from anyone under the age of 13 without verification of parental consent, we will take steps to remove that information from our servers. If you are a parent or guardian and you are aware that your child has provided us with PII, or you believe we may have any information from or about a child under 13, please notify us using one of the methods on our Contact page so we may take appropriate action.

How Can Users Correct Inaccuracies in Their Personal Information?
Visitors and Customers may contact us to update or correct inaccuracies in their PII via the contact form on the Site. Note that the Company is unable to correct and is not responsible for correcting any inaccuracies Visitors and Customers may discover in data collected by third parties. Visitors and Customers must contact those third parties directly and follow their respective information correction mechanisms and policies.
Can Users Delete or Deactivate Information You Collect?
We provide Visitors and Customers with a mechanism to delete or deactivate PII from the Site’s database by contacting us via:

We can also direct service providers to delete your personal information from their records.
However, because of backups and records of deletions, it may be impossible to delete all PII without retaining some residual information. An individual who requests to have PII deactivated will have this information functionally deleted, and we will not sell, transfer, or use PII relating to that individual in any way after that time. All Visitors and Customers acknowledge that removal of this information may in some cases limit or prevent us from delivering our Services and displaying or enabling them to use certain areas of the Site. All Visitors and Customers also acknowledge that we may need to retain some of this information for tax and/or legal reasons, as well as for data scrubbing lists.
Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:
- Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, and provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
- Debug to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act;
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
- Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
- Comply with an existing legal obligation; or
- Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Unsubscribe from Third-Party Communications
The Company does not control and is not responsible for third-party communication policies. The process of unsubscribing from communications sent by any third party is governed solely by that organization’s policies. In some cases a third party may provide a mechanism that allows us to unsubscribe Visitors and Customers from certain communications sent by that third party. These mechanisms change frequently and without notice. If you would like us to attempt to unsubscribe you from certain announcements from third-party partners of the Company, you may make that request by contacting us using the contact information provided in this policy.
Do You Follow Do-Not-Track Settings?
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
Do California Residents Have Specific Privacy Rights?
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits Visitors and Customers who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the form on our Contact page.
If you are under 18 years of age, reside in California, and have a registered account with the Site, you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the form on our Contact page, and include the name and email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.). Acquisition or Changes in Ownership
In the event that another individual or organization acquires the Company (or a substantial portion of its assets), your information would be considered part of those assets, and may be part of the assets that are transferred.
What happens if the Privacy Policy Changes?
The Company reserves the right to change this Policy from time to time. For example, when there are changes in our services, changes in our data protection practices, or changes in the law. We will inform Visitors and Customers about changes to our Privacy Policy by posting those changes on this page. The date the Privacy Policy was last revised is identified at the top of this page. If we make material changes to how we treat Customers’ personal information, we may notify Customers by emailing the email address specified in their account. Customers are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically visiting the Site and this Privacy Policy to check for any changes. Your continued use of the Site and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by that Policy.
